Sutton Forest Land Enclosure.

Whereas by an Act of Parliament made and passed in the thirty-fourth year of His present Majesty King George the third a.d. 1794 intitled An Act for dividing and enclosing the several Commons and Waste lands within the Manor and Parish of Sutton-in-Ashfield, Co. Notts. (After reciting that there were within the parish of Sutton-in-Ashfield several Commons and Waste Grounds containing by estimation two [2] thousand acres or thereabouts, and that the most noble William Henry Cavendish, Duke of Portland was Lord of the Manor of Sutton-in-Ashfield and owner of the soil of the said Commons and Waste lands [except a certain portion thereof called the Assarts] as parcel of and belonging to the said Manor and that the Most Noble William Duke of Devonshire was Impropriator of and entitled to all the Tithes both great and small arising renewing and increasing within the said parish of Sutton-in-Ashfield and that the said Duke of Devonshire, the Most Noble Thomas Ffiennes Pelham Clinton, Duke of Newcastle, John Lindley, Esq; and divers other persons were proprietors or Owners of Messuages, Cottages and Lands within the said parish .... in respect thereof were intitled to right of commons in and upon the said Commons and Waste Grounds, and that the said Commons and Wastes were in their situation incapable of improvement and that it would be very advantageous to the several parties interested therein to have them divided and enclosed and specific shares thereof allotted to them according to their several and respective Rights, Estates and Interest therein). It is by the said recited Act Enacted that said Thomas Fletcher, since deceased, John Renshaw and Joseph Outram are appointed Commissioners for dividing Allotting and Enclosing . . . . And it is further enacted that a true and correct survey admeasurement and map should be made as soon as conveniently might be. It further recited on page 3 "that all Allotments which should be made from or upon the said tracts or parcels of land called the Assarts to the owners and proprietors of Estates within the said parish of Sutton-in-Ashfield for or in respect of their interests therein and also all other Allotments which should be made from or upon any other parts of the lands or grounds intended by the said Act to be enclosed to such Owners and Proprietors as aforesaid in lieu of their shares and proportions of or in such tracts or parcels of land should from and immediately after the execution of the award of the said Commissioners be deemed of Freehold Tenure, and should be discharged of all Suits and Services manorial rights and incumbrances whatsoever. And whereas the said Commissioners after meeting and taking the Oath, appointed James Dowland of Mansfield Woodhouse, but now of Cuckney, Gentleman, Surveyor under the said Act."

Thomas Fletcher died 29 October, 1796 and William Wright aforesaid was appointed in his place by the Duke of Portland. It goes on . . . . "We find by the said Survey made by James Dowland that the ancient inclosed Lands within the Manor and Parish contain together in the whole by statute measure Three thousand and eighty four acres, two roods, and thirty-four perches. And the Commons and Waste Lands contain together in the whole (including Roads) Three thousand and ninety two Acres and thirty-four perches.

And whereas the said Thomas Fletcher deceased and we the said John Renshaw and Joseph Outram duly proceeded to execute the said Act and after making and settling out the Roads and Ways and the Allotments hereinbefore directed for the repairs thereof, and also the Allotments to the Duke of Devonshire as Impropriator of Tithes, and to the Duke of Portland as Lord of the Manor accurately ascertained and fixed the value quantity share and proportion respectively which the several respective owners of land and proprietors of Farm Houses and Cottages in the psh of Sutton-in-Ashfield having right of Common as aforesaid were or ought as such proprietors to have several and respectively set and allotted to them for and in respect of their Interests in the said Tracts or parcels of land called the Assarts, and when or so soon as the said T. Fletcher, J. Renshaw and J. Outram had ascertained the Shares of the several persons interested accordingly allotted and set out indiscriminately such shares to the several persons intitled thereto either upon the Assarts or upon the residue of the Commons or Waste Lands as best suited the convenience or accommodation of such persons respectively, and did also delineate in the map annexed the Freehold and Copyhold parts of each Proprietors Allotment, and described such part of each Allotment to be Freehold as was set out in respect of the Proprietors interest in the Assarts and the other part which was set out in respect of the Proprietors interest in the residue to be Copyhold.

And whereas the said T. Fletcher died 29 October, 1796 (after in part executing the said Act) and soon after the said William Wright was appointed a Commissioner by the sd. D. of Portland, and has since taken the Oath and proceeded along with J. Renshaw and J. Outram to further execute the said Act.

NOW KNOW YE that we the said W.W., J.R. and J.O. having in all things acted agreeably to and in pursuance of the said Act and duly and impartially considered the several matters . . . . Do make, form and draw up this our Award in writing as directed by the Act concerning the premises in manner and form following, that is to say, We find by the said survey made by James Dowland that the ancient enclosed lands amounted to 3084 Acres, 2 Roods and 34 perches, and that the Commons and Waste Grounds to be divided were 3092 Acres, 2 Roods and 34 perches, and we have annexed to this our Award a fair Copy of the Map of the said enclosed Lands together with the Awards of the several arbitrators appointed under the said Act . . . . and we direct that such Map and Plan shall be taken and considered as part of this our Award and in conformity to the said Act specified and described in the several Allotments made to the respective Proprietors of ancient Copyhold Estates (in) the said parish such quantities thereof as are allotted to the said Proprietors in respect of their interest in the Assarts, and also such quantities thereof as are allotted to such Proptrs. in respect of their interests in the residue of the sd. Commons and Waste Lands and have accordingly declared that such parts of the sd. Allotments as are made to the sd. Proptrs. in respect of their interest in the sd. Assarts are of Freehold Tenure, and that the remaining part of the sd. Allotmts. in respect of their interests in the residue of the Commons are Copyhold Tenure.

TIBSHELF TURNPIKE ROAD. Also we set out and appoint the following public Carriage Roads or Highways, Bridle roads and Footways over the (different ?) parts of the sd. parish of Sutton-in-Ashfield that is to say one public Carriage, Bridle and Drift Road beginning at or near Toot-hill and thence extending in a Westerly direction over the sd. Commons and Waste Grounds being the present Turnpike Rd. from Mansfield to Tibshelf wh. road so far as the same is in the parish of Sutton we have set out the breadth of 30 feet from the centre thereof to the S. ditch or Fence bounding the same, and distinguish it by the name of Tibshelf Turnpike Road.

ALFRETON TURNPIKE ROAD. Also one public Road etc. being the present turnpike Road from Mansfield to Alfreton beginning at the W. end of an ancient lane called Mill Lane and thence extending in its present direction over the sd. Common to the S. W. corner of an Allotment No. 171 (bottom of Forest or Eastfield Side) in the sd. Map herein made to Samuel Outram and from the W. end of an ancient Lane called Fulwood Lane in its present direction over Fulwood Common to the Liberty of South Normanton which road we have set out sixty feet between the ditches or fences bounding the same, and call such road the Alfreton Turnpike Road. NEWARK TURNPIKE ROAD. And one other public etc. Road being the present road leading from Sutton to Newark at the E. end of an ancient road called Forest Lane, and thence extending in its present direction over the sd. Forest to the Liberty of Mansfield which road we have set out the breadth of Sixty feet between the Ditches, and called it Newark Turnpike Road.

DERBY TURNPIKE ROAD. Also one other public C.B. & D. Road being the present turnpike road from Mansfield to Derby beginning at the Liberty of Mansfield at the N.W. corner of an Allotment No. 312 (now called Cocked Hat Plantation) herein made to the Duke of Devonshire and thence extending in its present direction S.W. to the Liberty of Kirkby which road we have set out sixty feet. NOTTINGHAM TURNPIKE ROAD. Also one other public C.B. and Drift Road being the present turnpike road from Mansfield to Nottingham, beginning at the N.W. corner of an Allotment No. 316 (nearly opposite Rushley Farm) made to the Duke of Devonshire over Commons etc. to the Liberty of Blidworth which road we have set out 60 feet. BLACKWELL TURNPIKE ROAD. Also one other public C.B. and Drift Road being the present turnpike road from Sutton to Blackwell Colliery beginning at the W. end of an ancient Lane called Hucknall Lane (near Portland Arms Inn, Huthwaite) and thence extending in its present direction over Fulwood (sic) Common to the E. end of an ancient lane called Hopkin Lane (nr. Blackwell Rd. Schools) which we have set out sixty feet.

SKEGBY ROAD. Also one other public C.B. & D. road beginning at Deepdale Gap (hollow where Dalestorth St. and Skegby Road join) and extending in a S. direction over the S.W. side of the Commons etc. to the E. corner of an enclosure called Eastfield Side belonging to the late Samuel Unwin (near Old Blue Bell Inn) and thence in a S. and S.E. direction to and over the bridge on the Mill Dam Brook to the Newark Turnpike road at the E. corner of an Allotment No. 267 (Blackmires corner opp. to) and hereinafter made to William Godber and thence over the Commons etc. to Derby T.P. road (Derby 4 Lane ends) at the E. end corner of an Allot, made to Saml. Outram, and thence to the Liberty of Blidworth wh. road we have set out forty feet between the Fences and called such road Skegby Road.

COCK LANE ROAD. Also one other public C.B. & D. Road branching out of Skegby Road at Deepdale Gap . . . .  by the side of Skegby Common to the Tibshelf T.P. road near S. end of Cock Lane wh. rd. we have set out 40 feet. HAMILTON ROAD. Also one other public C.B. & D. Road branching out of the Newark Road near the Longford Brook (near Sutton Rl. Junction) and extending in a N. and N.E. direction over the Commons and Waste Lands to the S.W. end of an ancient Lane in the Liberty of Mansfield called Hermitage Lane and thence branching E. to the W. end of an ancient Lane now called Hatch Car Lane which road we have set out 40 feet and called it Hamilton Road (turning E. to Bleakhills).

SMEETHE ROAD. Also one other C.B. & D.R. branching out of the Newark Road at the N.E. corner of an Allot : No. 272 made to Thomas Penistant (tone) and extending in a S. direction to an ancient Gate called Smeethe Gate which road we have set out forty feet.

HUCKNALL ROAD. Also one other public C.B. & D. Road branching out of the Alfreton turnpike road at the S.W. corner of Allot. No. 118 made to the heirs of the late John Lindley, Esq. (bottom of Fulwood Cutting W. end) extending in a N. direction over Fulwood Common to the S. end of an ancient lane at the N. corner of Hucknall Green, and from the N. corner of an ancient enclosure called Fall belonging to William Dufton and extending N.W. on the W. side of Allot. No. 7 made to Robt. Storer (bottom of Harper Lane to Skegby Foot Road) which road we have set out 40 feet.

FULWOOD ROAD. Also one other public C.B. & D. road branching out of the Alfreton T.P. road at the N.E. corner of Allot. No. 110 made to Nathaniel Stubbins, Esq, in Trust for the Stanton Charity, and ex. S.E. over Fulwood Common to the N.E. end of an ancient lane leading through Fulwood Farm (to Pinxton) which road we have set out 40 feet.

PUBLIC BRIDLE ROADS. Also one public Bridle Road as delineated in the Map over and through an Allotment No. 311 on the said Map made to His Grace the Duke of Devonshire beginning at the S. end of the Kinting Lane in the Liberty of Mansfield and extending in a S. and S.E. direction over the said Commons and Waste Lands by the S. side of Mansfield Enclosure to the Liberty of Mansfield which road we have set out at the breadth of 15 feet. (This road leads from Bleakhill Dam, through Coldwell Wood to Cocked Hat Plantation on Mansfield and Derby Road).

Also one other public Bridle Road through an Allot. No. 109 made to His Grace the Duke of Portland beginning at the Bridle Gate at the N.E. corner of an ancient enclosure belonging to the said Duke called Great Cross Gate and ex. over Fulwood Common to the Alfreton T.P. road near the S. end of Hucknall road before described, which road we have set out 15 feet. (Part of an ancient Bridle Road from Hucknall to Kirkby).

Also one other public Bridle Road . . . . through an Allot. No. 316 herein made to His Grace the Duke of Devonshire beginning at the Nottingham T.P. road and ex. in E. and S.E. direction over the said Commons and Waste Lands to the Liberty of Blidworth which road we have set out 15 feet. (This road commences about 150 yards from the Stream on the S. of Harlow Wood and leads through Fountain Dale to Blidworth).

Private Roads.

Also one Private Road of 24 feet from Skegby Rd. to Allot. No. 292 made to Thomas Clarke, of Hardwick, Yeoman. (Top of Coxmoor on right).

Also one of 21 feet from Skegby Road into Allot. No. 300 to the Duke of Devonshire. (Occupation Lane on left). EASTFIELD SIDE ROAD. Also one other private C.B. & D. Road to the breadth of 30 feet from Alfreton T.P. Road in a S.W. direction to the Skegby Road at the W. corner of an Allot. No. 261 made to the Surveyors of Highways for the use of the Owners and Occupiers of the lands to which the said road leads and which road we call the Eastfield Side Road. (This Road runs on the N. side of the Hillocks to the Lane End, now known as Unwin Road).

Also one other Private Rd. of 21 feet from Skegby Rd. at the S. corner of Allot. No. 203 made to William Hall to an Allot. No. 223 made to Susanna Bingham in a N. direction to Alfreton Rd. and also from S. corner of Allot. No. 220 made to Francis Burton in a N.E. direction to No. 230 made to Francis Burton to an Allot. No. 231 made to Saml. Boot, and thence in a N.E. direction to Alfreton T.P. Rd. (Now named Chapel and Barn Streets).

Also one other Private Road of the breadth of 20 feet from Blackwell Road to, in a N. direction, an ancient enclosure belonging to assigns of Jno. Lindley Esq. and thence in an E. direction to an ancient enclosure belonging to Saml. Unwin and Geo. Hodkinson for the use of the said Owners and Occupiers, (adjoining Portland Arms Inn, Huthwaite, and is Path to Stanton Hill).

Also one other of 20 feet along N.W. side of an ancient enclosure belonging to William Fletcher and others to an ancient Enc. belonging to the late Saml. Unwin (now named Great Fall Street).

Also one other of 15 feet from Blackwell T.P. Road to an Allot. No. 6 for the Duke of Portland's use (now a Street).

Also one other of 30 feet from Blackwell T.P. Road in a W. direction to Hucknall Road (now a Street) and thence of 40 feet to the S.E. corner of Harper Lane (now E. side of Huthwaite Market Place) which road we call Harper Lane Road.

Also one other private road of 15 feet from Hucknall Rd. over Allot. No. 22 made to Thomas Bloomer to a building in the W. corner thereof belonging to the Duke of Portland. Also one other of 11½ feet from Hucknall Rd. on N. side of Allot No. 17 made to William Jackson to an ancient encl. belonging to George Hodgkinson for his use. Also one other of 20 feet from Blackwell T.P. Road at W. end of Hopkin Lane on E. side of an anc : Encl : belonging to Richard Leaver in Trust for the Society of Quakers, to the N.W. corner of an Allot. No. 80 made to the D. of Portland, and thence on the N. side of Allot. No. 80 to the distance of 18 yards for the use of Owners and Occupiers of lands to wh. it leads. (On side of Burtons, later Robinson, Farm).

Also one of 18 feet from Blackwell T.P. Rd. in a S. direction to an Allot. 144 made to Henry Barker. (At rear of U.D.C. Office and Library).

Also one of 18 feet from B.T.P. Road at end of Hucknall Lane on the E. side of Fulwood Common to an anc : Encl: called Langford Barn Close which sd. road we call Crossley Hill Road. (Road to Colliery).

Also one of 18 feet from Hucknall Rd. to an Allot. No. 84 made to William Smith and also over Allot. No. 83 made to the D. of Portland to an Allot. No. 85 made to John Stephenson. (On W. side of Common Road).

Also one of 16 feet from Hucknall Road over N. side of Allot. No 88 made to Thomas Bury and Mrs. Diana Molyneux to N.E. corner of an anc : End. No. 98 called Nun Brook for use of the above. Also one of 15 feet from Hucknall Road through Allot. No. 100 made to the D. of Portland to Allot. 99 made to the same. Also one other of 16 feet from Alfreton T.P. Road by the E. side of an anc : Encl: in Liberty of S. Normanton to Allot. No. 106 made to and for the use of Joseph Hucknall.

Also one of 20 feet from Alfreton T.P. Road on the E. side of Fulwood Common to an anc : Encl : called Nether Hanning belonging to John Clarke for the use of the Owners. (1st Lane on R. through Cutting).

Also one other of 15 feet from the last described Road over and through an Allot. No. 126 made to Nathaniel Bacon to Allot. 127 made to Caulton Leeson for his use. (Road from Stoney St : across the Lawn).

And we do Order that the road leading from the Mansfld and Alfreton T.P. Road at the end of Bull Lane (New Cross) along the said Lane and over old Enclosures called Bull Pingle (Stoney St :) to Great East Field thence along a Lane and over old Encl : called the Croft and wood man dale thence along an ancient lane etc. and called the Lawn to a Gate in Mr. Unwin's Fence near the corner of a Close belonging to the D. of Devonshire called Doosen Close at the Forest Lane, which hath heretofore been wholly used as a public Bridle Road and footway and part thereof as a private road shall only be used hereafter as a public Footway and that such parts thereof as have heretofore been used as a private occupation road shall still continue to be so used. But that the said road shall wholly cease and be no longer used as a public Bridle Road.

And we do set out one public Footway as delineated in the Map from the Liberty of Mansfield over and across an Allot. No. 313 (back of Rushley Farm) made to the D. of Devonshire to the Liberty of Blidworth. (Through Thieves Wood to Normans Wood).

Footway from Junction by Farm to Nottingham.

Also one other public Footway from Newark T.P. Road at N.E. end of Smeethe Road over and across Allot. Nos. 280 and 291 to the Skegby Road at the N.E. end of a private road leading from Skegby Road to Allot : 292 (Kirkby Plantation).

Footway from S.W. End of Smeethe Rd. to Stream.

Also one other public Footway as delineated from an ancient Stile near the S.E. corner of Allot : 279 to Thomas Clarke of Hardwick over and across the said Allot : to Smeethe Road.

Also one other public Footway across the W. side of Allot : 262 made to the late Saml. Unwin to an ancient Stile at the S.W. corner (From Sutton Old Works to Skegby Rd. via Dukes Cottages).

Also one other public Footway from an ancient Stile over N.E. corner of Allot : No. 7 made to Robert Storer across to Blackwell T.P. Road. (Foot of hill at Huthwaite to Foot-road to Stanton hill).

Also one other public Footway from S.E. corner of Allot : No. 7 made R. Storer over and across Allot : No. 8 made to William Dufton to anc : Encl : belonging to the said W. Dufton. (Huthwaite).

Also one other public Footway from Hucknall Road (Common Side) over N. side of Allot : No. 143 made to Michael Askew to Cancer Well (4th field below Parish Church of Huthwaite on its N. side).

And we do also Order and Direct that the herbage and produce of such the said public and private roads as are by the said Act or by this our Award directed to be Fenced on both sides and likewise of the Allotments set out and allotted for materials for the repair thereof shall be vested in the Surveyors for the time being of the said parish In Trust to let the same for the best price that can be had or gotten for the purpose of mowing only, and not to be depastured with Cattle, and the money arising therefrom to be accounted for in the same manner as other monies coming to their hands by virtue of their said office.

Also we set out and allot unto the Surveyor of Highways of the sd. Parish of Sutton-in-Ashfield one piece or parcel of land upon Fulwood Common No. 10 in the sd. Map containing One rood and thirty eight perches or thereabouts bounded on the E. by Allot. No. 11 made to Charles Ellis and No. 12 made to John Ward, on the West by Hucknall Road and on the North by Harper Lane and on the South by the said Allot. No. 12 and we do order and direct that the fences for inclosing the said Allotments on the W. and N. sides thereof shall be made and for ever hereafter repaired by the said Surveyors of Highways or their successors or the owners or occupiers of the sd. Allotment for the time being. (This Allotment is now used as Huthwaite Market Place).

Also one piece of land . . . . upon the said Common No. 150 on the said Map . . . . This Allot : is at rear of the Council Offices, and was exchanged in 1893 for land in Oddicroft Lane now covered by Messrs. Barringer Tin Printing Works).

Also one piece of land upon the Forest No. 236 in the said Map containing 28 perches bounded on the N.E. and N.W. by an Allotment No. 235 made to the heirs and assigns of Cornelius Hufton deceased, on the S.W. by Skegby Road, and on the S.E. by an Allot : No. 237 made to the heirs and assigns of Thomas Cotton deceased.

(This Allot. is included in a field, late the property of Mr. Walter Straw, as being too small for letting separately. It should be sold as a building site, 1908. G.G.B.).

Also one piece of land on the Forest No. 261 containing 1 A. 37 P. (Known as the Hillocks, and now used as a Recreation Ground).

Also one piece . . . . of land . . . . No. 277 . . . . containing 2 Roods and 26 Perches (This Allot : now (1908) much increased in area is on the Maun near the Cart & Horse Inn, and let as a Garden).

Also one piece of land No. 296 containing 1 Acre & 21 Perches. (On Coxmoor now (1908) used for a Reservoir).

Also one piece . . . . of land . . . . No. 314 . . . . containing 1 Acre and 19 Perches. (In Thieves Wood bordering the ancient Great Way of a.d. 1232 to Nottingham and close to Well of Kirkby Water Works is included in The Wood and planted by the D. of Portland).
